What
is H1-B Visa ?
The
H1-B is a non-immigrant classification used by
an alien who will be employed temporarily in a
specialty occupation. The H1-B visa program is
primarily a USA work visa OR work permit.
The
US Government introduced the H1-B visa to offer
and enable highly skilled alien professionals
and international students from all over the world
the opportunity to live and work in the USA. The
H1-B visa enables US employers to hire foreign
professionals for a specified period of time.
You cannot get an H1-B without an employer.
Generally, the H1-B visa is valid for three
years. However, it may also be extended
for an additional three years resulting in a
six-year maximum. If you seek a second
H1-B because you changed employers, this will
not extend your stay under the H1-B for another
six years. The absolute maximum duration for a
visa under the "H" category is six years.
After completing six years in total on H1-B visa,
an alien must remain outside the United States
for one year before another H-1B petition can
be approved. Certain aliens working on Defense
Department projects may remain in H-1B status
for 10 years. In addition, certain aliens may
obtain an extension of H-1B status beyond the
6-year maximum period, when:
- 365
days or more have passed since the filing of
any application for labor certification, Form
ETA 750, that is required or used by the alien
to obtain status as an EB immigrant, or
- 365
days or more have passed since the filing of
an EB immigrant petition.
One
of the main advantages of the H1-B visa is that
it is a 'dual intent' visa which means that you
can apply for a Green Card (Legal Permanent Residency).
H1-B visa will not be denied simply because a person
has intentions to become a permanent resident. The
assumption is that if for some reason the permanent
residency petition is denied, the person would still
have the intention to return home.

H1-B visa qualifying occupation categories are jobs
in the fields of computer science, health care,
engineering, law, accounting, financial analysis,
management consulting, university teaching, architecture
and scientific research positions. An individual
can NOT sponsor their own H1-B visa. To obtain H1-B
visa, process is as below.

You must first find a job with a US employer
(sponsor)

Then your prospective employer (sponsor) files
your H1-B application with the USCIS

USCIS approves your H1-B application.

If you are applying for visa for the first time
then you need to get the visa stamped on the
passport in your country of residence.

If the H1-B application is applied for while
the candidate is in the U.S., then the candidate
can start working with the new employer as soon
as USCIS provides the receipt of the application.

You can start work in the USA for your new employer.

Once the H1-B approval comes through, the candidate
needs to get visa stamped on the Passport. This
has to be done before entry/reentry into the
USA.
